See chapter 11 for information about a recent clarification of G.L. c. 149, § 19B to create a private right of action to enforce the statute's notice provision. A 2024 case cites a denial of a motion to dismiss an action brought by a job applicant alleging that the employer failed to provide him with notice of his statutory rights before he unwittingly participated in a virtual interview that involved the use of AI to analyze the applicant's facial expressions, eye contact, voice intonation, and voice inflection.
