The new Massachusetts Uniform Probate Code changes the rules of intestacy and offers informal probate as an alternative procedure to settle estates. What ethical issues are raised by these developments and other developments? Article V on guardianships has already become law. The rest of the UPC will go into effect on July 1, 2011. Should estate planners and estate attorneys change their methods of practice in anticipation of the July 2011 effective date? This seminar addresses issues of concern for both the attorney and the fiduciary including issues regarding guardians or conservators payment of fiduciary fees. The panel also discusses the requirement that a petitioner notify the court if the incapacitated person requests counsel to oppose the petition.
