When a civil trial in Superior Court looms on your horizon, you need to be prepared. This program provides you with a comprehensive overview of both nonjury and jury civil trials in the Superior Court and explains the paperwork and preparation required for you to succeed.

Agenda

  • Motions in Limine/Jury Selection/Voir Dire/Witnesses/Opening Statements: Motions in limine-how, when, and why to present them. How the jury selection process works and how to keep track of it as it happens. The use of voir dire. The use of peremptory challenges and challenges for cause. The dos and don'ts of openings. Procuring and arranging attendance of witnesses.
  • Presenting Evidence/Asserting Objections/ Preserving Record for Appeal/Use of Depositions, Chalks, and Exhibits:  Practical considerations in presenting evidence. When, how, and whether to make evidentiary objections. Proper uses of depositions. Mechanics of using chalks and exhibits. When to make offers of proof and when to request sidebar conferences.
  • Motions for Directed Verdict/Jury Instructions/Requests for Findings and Rulings in Jury-Waived Cases:  The essentials for motions for directed verdict. Considerations in preparing requests for jury instructions and how, when, and whether to object to the instructions given to the jury. The drafting of requests for findings of fact and rulings of law: what you should include and when to present them.
  • Verdict Forms/Closing Arguments/ Questions During Deliberations/Post-Trial Motions: Considerations in proposing the use of special or general verdict slips. The dos and don'ts of closing arguments. How to handle questions during juror deliberations. The handling of motions for a new trial, judgment notwithstanding the verdict, additur, and remittitur.
