If you represent a client with a case pending in Massachusetts, or are about to file a lawsuit (or were just served with one!), a refresher course is in order. Recent changes affect how you must proceed, and necessarily impact strategic and other decisions you must make. This program reviews a series of significant amendments to the governing rules of procedure, and caselaw interpreting those rules, in both state and federal courts in Massachusetts. It also offers practical insight into how these revisions may dictate strategy, including choice of forum. The program provides the opportunity to learn about the new tools which are at your disposal before your adversary does (and prevent any unwelcome surprises).
The panel discusses developments in several areas, including pleading standards, expert discovery, summary judgment, written discovery and how the chosen forum can affect the opportunities-as well as the obligations-of both litigants and counsel in Massachusetts courts.
