      In this edition, you will find updates on topics such as the following:

      • Title insurance. See chapter 1 for a comprehensive practice note on the topic of "enhanced" or "upgraded" title insurance policies for lenders and owners. The note includes a practical warning about disclosure regarding com-missions taken from title insurance premiums and the impact on the attorney-client relationship. Chapter 1 also offers guidance on use and occupancy agreements and their use by clients who need to sell in order to purchase as a means to avoid a same day transaction. The practice note addresses the difficulty that can arise with the need to separate a use and occupancy agreement from a standard representation.
      • Standard form of offer. See chapter 2 for information that is useful when one is representing a buyer whose abil-ity to purchase a property is dependent on receipt of funds from the sale of the buyer's current home. With regard to the sale of rental property or a multifamily building, there are certain statements that must be included in the offer—chapter 2 recounts them.
      • Home inspection waiver. See chapter 4 for a warning about the pitfalls associated with forgoing a thorough prop-erty investigation prior to making a binding commitment to purchase real estate. The chapter cites a state senate bill filed in the 2023-24 session of the General Court, entitled: "An Act Protecting Consumer Rights in Purchasing Safe and Habitable Homes," and the impact on buyers' rights with regard to the waiver of inspections.
      • Title searches. Chapter 5 addresses the instances in which a title dependent on a deed from heirs of a person for whom there are no Massachusetts probate proceedings is not defective.
      • Financing real estate transactions. See chapter 6 for a variety of new ALTA forms and redlined comparisons between current and earlier documents.
