On June 28, 2018, Governor Charlie Baker signed into law a so-called "grand bargain" designed to keep proposed ballot questions concerning paid family and medical leave, the minimum wage, and a sales tax reduction off the November 2018 ballot. The new law creates what some have described as the most generous family and medical leave program in the nation. Starting on January 1, 2021, Massachusetts workers will be entitled to up to 12 weeks of paid leave to care for a sick family member or newborn, and up to 20 weeks of paid medical leave to attend to their own serious health conditions. Although the program will be administered by the Commonwealth and funded through payroll taxes, the new law creates a host of new requirements and prohibitions for employers.
In addition, the law provides for an increase in the hourly minimum wage from $11.00 to $15.00 per hour over 5 years. At the same time, the law provides for the phasing out of required time-and-a-half pay on Sundays during the same 5-year period.
