This program is designed to acquaint new and experienced practitioners with sentencing advocacy in both the District/Municipal Courts and Superior Courts. The program also explains parole hearing procedures as well as the information the Parole Board wants from advocates and insights on medical parole.The Judges and experienced practitioners offer advice on how to prepare and make effective sentencing arguments based upon their collective experience. They highlight arguments that have been less effective to assist attorneys with avoiding those pitfalls. The panel discusses mandatory minimum sentences and provides some strategies as to how to counsel clients about them. Attorneys who work in the corrections system discuss sentencing dispositions, particularly execution and computation of sentences, parole eligibility and jail credits. The panel also discusses the parole process, and how to navigate it, including applications for medical parole.
The experienced panel offers tips on pre-disposition sentencing discussions, the Massachusetts Sentencing Guidelines, and what factors are appropriate for a judge to consider in determining a sanction. The factors that determine the likelihood of parole are emphasized. Don't miss a chance to hear from an expert panel that includes Judges, practitioners, and classification specialists.
