Learn how mental health conditions can manifest, impact a tenant’s ability to comply with their tenancy, and affect judicial process, along with information on housing providers’ legal obligations, community resources, legal supports, and crafting creative responses.
After COVID-19, there was a noticeable increase in mental health issues affecting relationships between landlords and tenants, between residents, and between tenants and others. The courts are challenged working with persons whose issues extend beyond an eviction action, and involve violence, threats, verbal and physical abuse, and refusal to follow procedure and process. The Housing Court’s ability to address mental health issues and resulting conduct is limited to within its ability to exercise equitable authority to find a solution, or a possible path to a solution, to address the issue. What can the parties and the Housing Court do when more permanent assistance is needed to address the challenges faced by the parties? In this new seminar, an experienced attorney who specializes in landlord-tenant law leads a creative and open discussion between an experienced Housing Court judge and an attorney who specializes in mental health issues. They touch on issues such as dual diagnosis problems, threatening or aggressive behavior, and inability to follow the required processes and procedure; locating persons or agencies which might be able to assist in stabilizing the situation on a short term basis; and using creative ideas to try to work out longer term supports and resources to work on the factors underlying the behavior.
