S.J.C. Judgment of Disbarment entered by Justice Kafker on December 17, 2018.
After the respondent defaulted, he was disbarred in a case of reciprocal discipline out of New York. The New York disbarment was based on the respondent’s failure to cooperate with an investigation into his conduct by the Attorney Grievance Committee.
The respondent, Christopher C. Humphrey, is an attorney duly admitted to the Bar of the Commonwealth on January 18, 2010. He also was admitted to the bar of New York State. On February 8, 2018, the Supreme Court of the State of New York, Appellate Division, Third Judicial Department (the New York court) disbarred the respondent from the practice of law in New York.
The New York court had suspended the respondent on June 29, 2017 for failure to cooperate, including failure to appear at a scheduled examination, in connection with an investigation being conducted by the Attorney Grievance Committee for the Third Judicial Department, into an allegation of misconduct by the respondent. The respondent then failed to file the required affidavit of compliance with the order of suspension. Six months following the issuance of the suspension order, the Attorney Grievance Committee moved to disbar the respondent for his failure to respond or appear for further investigatory or disciplinary proceeding for a period of more than six months after the date of his interim suspension. On February 3, 2018, the New York court disbarred the respondent.
On September 24, 2018, bar counsel filed a petition for reciprocal discipline with the Supreme Judicial Court. The respondent did not file a response to the petition. Following a hearing before Justice Kafker on December 13, of which the respondent received notice but did not appear, the Court issued a reciprocal Judgment of Disbarment, effective immediately.
