In a case of reciprocal discipline from New Hampshire, the respondent’s law license was suspended for two years with reinstatement conditioned on his reinstatement in New Hampshire.
SUMMARY
The respondent, Donald Reed Nary, II, is an attorney duly admitted to the bar of the Commonwealth on December 16, 2004. In 2016, he was administratively suspended from practice in Massachusetts for failure to register. The respondent was also admitted to practice in the State of New Hampshire.
On March 15, 2019, the State of New Hampshire Supreme Court suspended the respondent from practice in New Hampshire for two years. The suspension was based upon a stipulation agreed to by the respondent and the New Hampshire Attorney Discipline Office’s disciplinary counsel. In that stipulation the respondent acknowledged that he had violated New Hampshire Rules of Professional Conduct 1.1, 1.3, 1.4, 8.4 (c) and 8.4(a). He further acknowledged that the appropriate sanction for the rule violations was a two-year suspension.
On March 29, 2019, bar counsel filed a petition for reciprocal discipline, pursuant to S.J.C. Rule 4:01§ 16, and the Order of the State of New Hampshire Supreme Court. Following a hearing on November 12, 2019, on November 21, 2109, the Supreme Judicial Court (Lowy, J.) entered an order suspending the respondent from the practice of law in Massachusetts for two years, with reinstatement in Massachusetts conditioned on his reinstatement to the practice of law in the State of New Hampshire and on his compliance with his administrative suspension.
