The wait is over! The standing order is on its way! Join members of the Superior Court Implementation Subcommittee and MCLE for the definitive program on jury voir dire. On August 6, 2014, Governor Patrick signed into law Chapter 254 of the Acts of 2014, which provides for attorney-conducted juror voir dire in all Superior Court trials. This February, the law will take effect and for the first time in Massachusetts attorneys will have the opportunity to question prospective jurors, screen for potential bias, and shape the ultimate jury selection in a manner not previously possible in the Commonwealth.
The ability of attorneys to question jurors can be invaluable to ensuring a fair and impartial jury panel. At the same time, judges must carefully preside over the voir dire process so that valuable court time is not wasted and the privacy of jurors is not unnecessarily invaded. In order to understand effective voir dire and jury selection strategy, and to implement this new skill into your practice, it is crucial that you understand the law and the standing order that will govern the way the law is implemented.
