    Strategic considerations for juror voir dire

    The statute permitting attorney-conducted juror voir dire went into effect on February 2, 2015. We now have two years of experience under this statute and the Superior Court Standing Order implementing it. This program provides a rare opportunity to learn from Massachusetts lawyers and judges who have conducted voir dire by observing attorney-conducted voir dire in action.

    Voir Dire: Watch & Learn gives you live demonstrations of both attorney-conducted panel voir dire and attorney-conducted side bar voir dire. Following each demonstration, the expert panelists thoroughly analyze what worked and what didn’t. They discuss issues that have arisen for both the lawyers conducting voir dire and for the judges managing the process. They also analyze how jurors themselves have reacted to this process—and what you can learn from their reactions.

    On the faculty are Superior Court judges and attorneys who have been among the first to experience the “brave new world” of attorney-conducted voir dire. You hear what is happening from the front lines and learn strategic considerations that will help you when you face your own juror voir dire for the first time.

    The Superior Court has gathered information from judges, attorneys, court clerks and jurors regarding their respective experiences with attorney-conducted voir dire. The Court’s report and analysis of that 360° input is anticipated this fall. A discussion of that report is also part of this very timely program.
