Attorneys must determine priority and account for private insurance, Medicaid, and Medicare liens when negotiating their client’s interests. The federal government tracks and enforces prospective payment of Medicare liens, warns about liability for post settlement Medicare Set Asides, and the Commonwealth requires payback of MassHealth through the date of settlement and after death. Likewise, private carriers have statutory authority for recovery. It may be difficult to determine the difference between private carrier coverage and MassHealth when the same HMOs and preferred providers manage both forms of coverage.
This program focuses on the effect that medical liens have on litigation and how to resolve the lien liability. Agency representatives and an experienced litigator offer explanations and practical tools to help navigate this challenging environment.
