    A trustee has the duty to make trust property productive, which requires the trustee to oversee the investment and management of the trust’s assets. This program provides an overview of the investment standards and fiduciary duties implicated by a trustee’s investment authority. The faculty review the fundamentals of modern portfolio theory, the Massachusetts Prudent Investor Act, and drafting considerations for trust language affecting a trustee’s investment obligations. Learn about best practices for selecting and working with an outside investment manager, the distinction between directed and delegated trusts, and how directed and delegated structures are implemented in different jurisdictions like Massachusetts and New Hampshire. Finally, this program addresses special fiduciary issues such as socially responsible investing, ESG (environmental, social, and governance) investing, and investing for charitable trusts.
