Employers’ obligations under the federal Fair Labor Standards Act (FLSA) and Massachusetts wage and hour laws are complex, and the statutes contain many nonintuitive requirements. Adding to the complexity is the fact that state and federal laws often impose differing requirements, and employers are expected to comply with the law that is the most protective of employees. Further, while both statutes provide for multiple damages as a remedy, treble damages are mandatory under state law, while the FLSA provides for an affirmative defense against such damages.
