    Alternative Dispute Resolution is a tool available to every attorney. Used thoughtfully, ADR—including mediation, case conciliation, special masters, arbitration, and other forms—can lead to positive client outcomes. Clients can gain greater control of the form, cost, and timing of a resolution of their case through ADR. Client satisfaction in turn can build referral sources and future business

    The Preamble to the Supreme Judicial Court’s Rules of Professional Conduct identifies the functions of an attorney as advisor, advocate, negotiator, and evaluator. At times, the legal process can distort the attorney’s role, from the attorney’s and the client’s perspectives, simply to the function of zealous advocate. ADR can assist attorneys in performing all the functions of the profession and re-focus the case on resolving the problem that led a client to an attorney. This focus is particularly important when that underlying problem is not a legal problem.
