Intellectual property is vital for many companies, and often the most important ideas can only be protected by patents. Patents are essential in many business plans. For example: a small high-tech company that wants to be acquired by a large company—or to offer a license to the large company—instead of having a large company simply copy the small company’s products; a pharmaceutical company that does not want its profit margins eroded by generic drugs; or a biotech start-up looking to raise capital and wanting to assure potential investors, etc. Companies need to understand what types of inventions can and should be protected by patents, be aware of deadlines for filing a patent application, appreciate whether a given patent strategy will be effective in preventing others from stealing the underlying inventive idea, keep track of what their engineers and scientists are working on, determine when to bring in a registered patent attorney or agent to protect an invention, make sure that the company owns the invention, and avoid infringing patents owned by other companies.
