    Using detailed guidance from recent case law, including Graham, Lampron, Dwyer, and Long, the program unpacks the prosecution’s obligations under Rule 14, the definition and scope of the “prosecution team,” and the increasingly nuanced standards governing disclosure of information favorable to the defense. Attendees gain practical insights into identifying what materials fall within the Commonwealth’s automatic discovery obligations, how prosecutors must investigate and disclose police-related credibility issues, and where the limits of Rule 14 end.

    The program then explores how and when Rule 17 serves as the necessary tool for obtaining records from third parties, including police departments, medical providers, employers, and other non-party entities. Attendees learn how to craft effective supporting affidavits, meet the “good cause” standard, and avoid the pitfalls of fishing expeditions or overbroad requests. With special attention to Internal Affairs records, surveillance footage, and the growing controversy over Long motions, this training provides attorneys with the strategies needed to navigate the shifting boundaries between civil-style subpoenas and criminal discovery obligations.
