Taught by attorneys on both sides of the case as well as those who prosecute attorney discipline cases, this MCLE course provides attorneys with a solid understanding of the unique ethical challenges and conflicts that arise in the criminal justice system each day. Ethical issues never arise in a vacuum, nor can they always be anticipated. Typically, the busy lawyer faces issues amidst the hurly-burly of a hotly contested criminal trial. Whether newly-minted, a mid-career lateral, or a seasoned pro, many practicing attorneys fail to recognize ethical issues when they happen. There are rarely clear-cut right and wrong answers to many of the ethical dilemmas that occur in criminal practice; however, a clear and careful resolution of these issues is the responsibility of the attorney under the rules of professional conduct.
Participants in this program are exposed to the array of ethical issues that they are likely to encounter in the practice of criminal law. An attorney’s professional conduct requirements are explored in relation to clients, other attorneys, the courts, the legal system, and the broader community. Integral to this program are the Massachusetts Rules of Professional Conduct and the manner in which the regulation of the legal profession is judicially interpreted. The rules, case law, and specific ethical problems and dilemmas are examined. The focus of this program is the practical operation of the rules of professional conduct.
The panel of experienced faculty provides an in-depth look at ethical issues facing criminal law practitioners, including a look at the attorney discipline process. With this knowledge, participants are better prepared to handle ethical dilemmas and safeguard a balanced and fair criminal justice system.
