This year’s fact pattern involves an accountant who had worked at a consulting firm for 20 years, who refused to comply with a new office policy requiring employees to clock-in and clock-out using a biometric hand scanner. The Complainant requested an exemption, asserting she "feared damnation" from its use. The Complainant believed the scanner was "part of an identification system and collection of personal information that would be used by the Antichrist, as described in the New Testament Book of Revelation, to identify followers with the 'mark of the Beast'" and explained that her religion—"Onionhead" forbade scanning. The firm denied her request and warned that she would face discipline, including discharge, if she repeatedly missed scans. After receiving two progressive discipline warnings for missed hand scans, the Complainant quit and filed a Charge of Discrimination at the MCAD.
