Whether you file a motion for a bill of particulars, or a motion to suppress, it can be the defining factor in whether you win or lose a trial, or whether you even need to go to trial. As criminal practitioners, it is important to think strategically about how we craft motions, and the long-term goals. Identifying the theory of the case should begin at arraignment, and our motions should assist in advancing our theory of the case. We should craft every motion in good faith, with the mindset of winning.
