Motions for Temporary Orders are often the judge’s introduction to the case. A temporary support or custody order entered in a busy motion session, or, more recently, via a limited Zoom or telephonic hearing, can last the length of the case and can act to set a precedent for final resolution of issues. It is critical that the motions, supporting affidavits, and proposed orders be specific, thoughtful, and detailed. There is no such thing as a “standard form” motion and now, more than ever, the court will rely on the written submissions. Every case has similar themes, but each case is unique on its facts. Distinguishing your case from the norm and providing the judge with the facts and evidence could warrant a hearing on an expedited basis and promote a ruling in your favor. Effectively presenting or defending a request for temporary orders is key to securing the relief sought.
