When you are outside counsel for a company, you receive all sorts of communications from that company: requests for a lease review, HR issues, customer contract complaints, etc. Since the end of 2022, you may also have received a new question: Do we need a generative AI policy? Organizations are increasingly worried about how their employees use and misuse generative artificial intelligence and how their customers might react to generative AI. On one hand, company leaders don’t want their organizations exposed to the well-publicized dangers of poorly used generative AI (loss of confidential information, libelous statements, unprotected intellectual property, etc.). On the other hand, AI holds the potential for cost savings and the development of new revenue streams if employees and customers use it properly.
